Ngaatec — Terms of Service

Welcome to Ngaatec. These Terms of Service ("Terms") govern your access to and use of our services, including web hosting, domain registration, web development, decoder subscription services (e.g., StarSat, DigiSat, MediaStar), and other digital services (collectively, "Services"). By using our Services you accept these Terms in full.

1. Who we are

Ngaatec is a technology company providing hosting, domains, development and digital subscription services. For support or legal queries, contact: support@ngaatec.com.

2. Eligibility

Use of our Services requires that you are at least 18 years old and have legal capacity to enter into contracts. Organisations must ensure they have authority to bind any entity on whose behalf they act.

3. Account responsibilities

• You must provide accurate information and keep account credentials secure.
• You are responsible for all activity under your account.
• Notify us immediately of any suspected account compromise.

4. Acceptable use

Clients must not use our Services to engage in unlawful activity or to host content that:

• Violates intellectual property rights
• Contains malware, phishing, or hacking tools
• Facilitates fraud, harassment, or unauthorized access
• Sends unsolicited bulk email (spam)

5. Payment, billing and refunds

Services are billed as described at purchase. Unless stated otherwise, fees are payable in USD. We reserve the right to suspend or terminate unpaid services. Refunds, if any, are subject to our Refund Policy and product-specific terms.

6. Service availability and maintenance

We aim to provide reliable Services but cannot guarantee uninterrupted availability. Scheduled maintenance will be communicated in advance when possible. We are not liable for outages caused by third parties or force majeure events.

7. Privacy and data backups

We process personal data in accordance with our Privacy Policy. Clients are responsible for maintaining backups of their content; Ngaatec is not responsible for loss of content except where otherwise agreed in writing.

8. Decoder subscription services

For decoder subscription services (StarSat, DigiSat, MediaStar):

• Subscriptions are subject to availability and third-party provider terms.
• Activation and provisioning times vary; delivery estimates are provided during purchase.
• Refunds and cancellations follow provider and Ngaatec policies.

9. Third-party services

We may use third-party providers (payment gateways, registrars, delivery partners). Ngaatec is not liable for their actions or service interruptions.

10. Termination and suspension

We may suspend or terminate services for breaches, fraud, or illegal activity. Upon termination, access to data may be removed; clients should download backups promptly.

11. Limitation of liability

To the fullest extent permitted by law, Ngaatec's liability for any claim related to the Services is limited to the amount paid by you for the relevant Service during the preceding 12 months. We are not liable for indirect or consequential losses.

12. Changes to the Terms

We may update these Terms from time to time. Changes will be published on our website with an updated effective date.

13. Governing law

These Terms are governed by the laws of Zimbabwe. Disputes will be subject to the courts of Zimbabwe unless otherwise agreed in writing.
